Terms and Conditions of Membership
All new membership application, membership freezing and membership transfers are subject to the approval of Clark Hatch Fitness & Sports Center Sdn. Bhd.
management (CHFSC). CHFSC management has the sole and complete discretion to accept or deny any application for memberships, without giving reason(s).
Enrollment fees, processing fees and membership fees are not refundable or transferable upon suspension, resignation or termination for any reason whatsoever.
Monthly billing date fall on 1st or 15th of every month. Dues are payable through credit card/bank direct debit. Failures to use the clubĄ¯s facilities dose
not eliminate the obligation to pay all subscriptions on time. The credit card / bank authorization balance must be sufficient to cover membership fee. A
late payment fee of RM10 per month will be imposed on dues and payments made after the 7th of each billing day. Any lapse in membership will require a new
joining fee for re-joining.
Unpaid accounts will be submitted to collections, and member will be responsible for all charges and collection fees.
Members may freeze their membership by continuing to pay a freeze fee equivalent to 30% of the current monthly subscription for each due. Members must give
a minimum of 14 days notice in writing and surrender the membership card to their home center prior to the first day of the suspended month and the freeze
period must be for a period of not less than one (1) month and not exceeding eleven (11) months.
The freezing period is based on calendar month and will start on the first day of the upcoming month. Membership shall automatically activate according to
application. Any form of verbal request for freezing of memberships will not be entertained. CHFSC will not entertain any request for back dated freeze and
members are obliged to pay all outstanding dues prior to an application for their membership to be frozen.
Medical leave is for a minimum period, of thirty (30) days. Members who have medical problems are required to submit a medical certificate to CHFSC for the
waiver of monthly dues during the leave period. Corporate membership is a fixed term membership. No freezing period or refund is applicable to this category
of memberships.
Transfer of Membership to other Clark Hatch Centers
Should you permanently relocate to an area with a Clark Hatch Fitness Centre, you may transfer your membership by paying applicable fees as required. Each
Clark Hatch Center is independently operated and therefore establishes its own rules and regulations and policies relating to transfer of memberships from
one center to another center. The terms and conditions relating to transfer vary from time to time and each center reserves the right to change such terms
and conditions without notice. Any transfer of membership or membership types within the Johor centers will incur an administration fee of RM200. Corporate
memberships may be transferred to another employee of the same company by written notification and return of existing membership card. An administration
fee of RM200 per transfer is chargeable.
Cancellation of Membership
Membership is for the agreed terms as stated on the agreement, paid either by cash upfront or by direct debit. After each membership terms, membership will
automatically renew unless member cancel the membership with a 30 day written notice before the membership term end. Any membership cancellation must give
one calendar month's advance notice, must be given in writing addressed to the Center Manager when terminating membership. All outstanding dues must be
settled and the membership card must be returned for the resignation to take effect. Any phone, email, verbal cancellations are not accepted.
Termination of Membership
The CHFSC may at its sole discretion terminate Center membership if a member CHFSC
a)Fails to pay any of his/her monetary obligations to the CHFSC whether under these rules and regulations or otherwise
b)Fails to follow the CHFSC rules and regulations, including time limits on cardio machines and any matter pertaining to gym etiquettes
c)Willfully damages CHFSC properties or building facilities
d)Enters incorrect or false information on his/her application form
e)Violates any government laws or regulations, or rules of the building management
f)Damages the CHFSC name and reputation through any actions
g)Fails to act in an orderly manner or engage in improper conduct or solicitation of any kind
The CHFSC management reserves the right to cancel any membership on which fees are unpaid for two months. Legal action will be taken to recover outstanding
dues from member.
Reciprocal Rights
CHFC are independently owned and operated. Members may use most CHFSC which are out of 50km radius of the center in which they hold membership. A member
using a reciprocal fitness center or multiple centers in one city for more than two weeks per year (the two starts from the 1st day of use and ends on the
14th day) must pay monthly fees for premier memberships at the reciprocal center. The official receipt must then be submitted to the manger of the center
where membership is held for an exemption towards that period. If visiting member has paid advance dues at his home centre then the receiving reciprocal
center will charge the balance of the monthly dues if the fee is higher. If visiting member is using several clubs within a city then the member will be
required to pay the balance of the premier dues.
Amendment of Rules & Regulations Fee Structure
CHFSC may at its sole discretion make such amendments to the rules and regulations, or the schedule of fees at any time and from time to time, without prior
notice or individual notice to each member. Such amendments shall be binding on all members.
Guest Policy
Members and their guest exercise and use the facilities at their own risk and are advised to consult their physician prior to commencing any type of physical
exercise. CHFSC and landlord accept no responsibility for loss or damages to membersĄ¯ or their guestsĄ¯ properties and belongings or for death or injuries
sustained while on the premises. Members and their guest agree that no claim will be mage against CHFSC management, staff of landlord for any reasons
whatsoever.
Members may bring a maximum of two guests at any one time by paying the guest fees on each visit. The same guest may be admitted for a maximum of three times
in a calendar year; thereafter the same guest will be charged the walk-in guest rate for admission. Guest(s) must be accompanied at all times by the member
who signed them in and members are required to pay for all charges incurred by their guest(s) and indemnify CHFSC and Landlord against all their defaults and
claims against CHFSC or the Landlord.
